Wills and Estates
In our estate litigation practice, we will assist you if you need to defend or challenge the validity of a Will, dispute the conduct or compensation of an estate trustee or someone acting as attorney under power of attorney for you or someone you know, have someone appointed as guardian of someone who is now mentally incompetent or resolve any other dispute involving Wills, estates, powers of attorney and/or mental incompetency.
On top of suffering the loss of a loved one, a beneficiary of someone’s estate can also be faced with concerns about actions or omissions by the estate trustee (formerly called an executor). Has the estate trustee failed in fulfilling his or her duties and responsibilities, or is the scrutiny unwarranted in the circumstances? Does the deceased’s Will properly reflect what you understood to be the deceased’s testamentary wishes? We will help you bring clarity to any kind of situation involving someone’s estate, whether you are the beneficiary, intended or excluded beneficiary or the estate trustee.
Equally stressful are the myriad of possible conflicts surrounding the appointment, actions or omissions of your or someone else’s guardian or attorney under power of attorney, whether in relation to property or personal care. Do you or someone you care about who has limited competency need a guardian appointed? Are you concerned that you or someone who you care about is being taken advantage of by a guardian or attorney under power of attorney?
However unique your circumstances in any of the above situations, we will bring clarity to your concerns and take whatever steps necessary to facilitate the most expedient and effective resolution in the circumstances. We can start a court action, navigating the court documents and rules that are particular to estate litigation or proceedings under the Subsitute Decisions Act, or we can lead the parties through alternative forms of dispute resolution when it makes sense to do so. We will learn about your case, help you learn how the law applies to your case and find the resolution that is most fitting for you.
